What is different in Florida
Florida requires judicial foreclosure: every mortgage is foreclosed in equity under F.S. §702.01 — the lender must sue and obtain a court judgment before any sale, and no non-judicial power of sale exists for Florida mortgages. That court schedule runs in months, and a direct purchase that pays the loan off at closing can work against it when the numbers allow. Florida is largely caveat emptor, but a residential seller must disclose facts materially affecting the property's value or desirability that the seller knows, that are not readily observable, and that the buyer does not know (Johnson v. Davis, 480 So. 2d 625 (Fla. 1985)). An as-is clause does not shield a seller who knowingly conceals a latent defect. We ask for the known items in writing either way — disclosed defects price into the offer instead of surfacing later.
Florida's homestead exemption is written into the state constitution (Art. VII §6) and F.S. §196.031: up to $25,000 of assessed value is exempt from all ad valorem taxes, with an additional band (CPI-adjusted each January 1) on assessed value between $50,000 and $75,000 other than school-district levies, and it requires legal or equitable title with permanent-residence occupancy on January 1. The application deadline of March 1 is codified in F.S. §196.011(1)(b) — a missed deadline costs the exemption for that tax year.
